内容記述 Amendment of the Fundamental Law of Education being one of the most crucial issues today, faculties and staffs of the Christian schools in Japan should have proper understanding as to how Christian view of man and society affected the law at its establishment and also how the law has constantly guaranteed the freedom of education in Christian schools throughout the postwar Japan. In this paper, I would like to discuss from several historical points the significance of the Fundamental Law of Education for the realization and future development of aims and practices of Christian schools. 1) In the process of drafting and polishing up the lines of the law, not a few Christians and Christian sympathizers played an important role in the discussion. Thus, the Fundamental Law of Education can be regarded as principles of education implicitly based on the Christian view of man and society. 2) The most important character of the new law is its expression of basic human rights overcoming the structure of 'codes of virtues' in the Imperial Rescript of Education, as well as its proclamation of "resolution to contribute to the peace of the world and welfare of humanity" through the power of education. 3) The philosophy on which the structure of 'codes of virtues' in the Imperial Rescript of Education was founded is the traditional idee recue on moral practices affected mainly by Confucian theory. Therefore the so called 'problematic' feature of the Fundamental Law of Education, attacked by the conservatives as too abstract or idealistic, is all the more significant in order to overcome the basic structure of 'codes of virtues' used in collective education for the purpose of state policy. 4) The common bases of Christian schools being the Words in the Testament, each member should hear the Words and respond to them in his/her own way according to their own faith and conscience. Thus, the faculties and staffs, whether they are Christians or Non-Christians, are able to share the ideals of the Fundamental Law of Education as expressions of the aims of education (especially ones for character building) of the Christian schools.
